This website is created and controlled by GameOn Motorsports. Use or access of this website constitutes agreement to comply with and be bound by the following terms and conditions.
GameOn Motorsports reserves the right to amend such terms and conditions at any time without
providing notice or reason to the subscriber.

2. MEMBERSHIP
If you are a website member, you may not have more than one active membership account with
GameOn Motorsports at one time whether it is by reason of change of name, email, or address.
However, you may update or terminate your membership account at any time.
If this condition is breached, you may become ineligible for any upcoming benefits or promotions as set out by the website.
As a member of the GameOn Motorsports website, you are solely responsible for maintaining the
confidentiality of your own account and password. You are solely responsibility for any actions that take place under your account and password, and any consequences which follow.

3. USE OF MATERIALS, GRAPHICS AND TEXT FROM THIS WEBSITE
Unless stated otherwise, the material on this website are presented only for the purposes of
promoting GameOn Motorsports products and providing information in relation to GameOn
Motorsports products to wholesalers and the general public. Material from this website must not be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way.

4. PRICING
All prices are charged in Australian currency. Unless stated otherwise, the total transaction amount provided by GameOn Motorsports may vary depending on the exchange rate used by your credit card company and the State from which you are ordering products.

5. PRODUCTION PRICING
GameOn Motorsports reserves the right to vary or modify the prices for its products on the website in accordance with wholesaler or discounted retail prices in which GameOn Motorsports chooses.

6. ORDERS
Orders will not be dispatched by GameOn Motorsports until payment has been received in full and GameOn Motorsports is satisfied with the integrity of the order.
After placing an order, you will receive an email from GameOn Motorsports acknowledging that we have received your order. Please note that this does not mean that your order has been accepted.
Your order constitutes an offer to us to buy a product. GameOn Motorsports reserves the right to accept (in whole or part) or decline any order. If GameOn Motorsports accepts your order, you will receive an email confirming that the Product has been dispatched

7. DELIVERY
GameOn Motorsports will ensure that products are delivered as soon as possible. It is the
responsibility of the customer to inform GameOn Motorsports if an order does not arrive. Once GameOn Motorsports have learnt that an order has not arrived in accordance with its due date, GameOn Motorsports will make all efforts to locate the lost order. If GameOn Motorsports are unable to locate the lost order, GameOn Motorsports may resend the existing order depending on the nature of the order’s disappearance.

8. RETURNS
All returns must be authorised by GameOn Motorsports. Returns will only be accepted within 30 days of the delivery date. Customers are responsible for the cost of shipping all returns and exchanges. Shipping and handling charges are not refundable.
GameOn Motorsports reserves the right to replace faulty goods depending on the nature of the fault. Any fault caused due to poor handling or incorrect use of the product will not be replaced.
Any product that has been opened, used, or damaged in any way may not be accepted for return by GameOn Motorsports.

9. PROMOTIONS & CONDITIONS
GameOn Motorsports reserves the right to set conditions upon all promotions and specials on the website. Promotions and specials are subject to change depending on the nature of the promotion and will not be eligible once the prescribed period has passed.

10. SPECIALS / DISCOUNT VOUCHERS
GameOn Motorsports Website Specials and discount vouchers are available for purchase from the website only. Vouchers are valid for 6 months from date of purchase. Vouchers are not refundable or redeemable for cash. Vouchers may not be exchanged for other products or services unless at the discretion of GameOn Motorsports.

11. LINKS TO THIS WEBSITE
Links to this website are not permitted under any circumstances. In the event of persons or
companies placing external links to the GameOn Motorsports website, GameOn Motorsports
assumes no responsibility for its content or use of materials from such sites or any subsequent site links back to the GameOn Motorsports website.

12. LIABILITY
To the maximum extent permitted by law, GameOn Motorsports will not be liable to any person or entity for any direct, indirect, consequential or other cost, expense, loss or damage (however caused, including due to negligence) which may arise out of, or in connection with, the use of this Website or the use or reliance on information, including any publication or media release,
contained on or linked to from this website.
GameOn Motorsports do not provide any warranty in relation to your use of this website or as to the currency, completeness or accuracy of the information contained on this website.
If any law implies a condition or warranty into these terms and conditions which cannot lawfully be excluded then, to the maximum extent permitted by law, the liability of GameOn Motorsports for any breach of such implied term will be limited to the supply of the relevant service again or the payment of the cost of having that service re-supplied.

13. INDEMNITY
13.1 Loss or damage
If you have contracted GameOn Motorsports to perform any mechanical works on your vehicle
which are outside the factory performance standards of the vehicle, such works are completed at your own risk. GameOn Motorsports is not responsible for any or all risks with respect to personal injury, death and/or property damage, resulting from the works.
GameOn Motorsports, its employees, servants and agents are released from all liability arising from any fines imposed by the relevant statutory authority, injury, loss (including any consequential loss) or damage that you suffer notwithstanding where such injury, loss or damage is caused by or arising from any negligent act, breach of duty, default and/omission by GameOn Motorsports,
its organisers, instructors, servants or agents.
13.2 Roadworthiness and Compliance
GameOn Motorsports is not responsible for ensuring the roadworthiness of the vehicle and its compliance with all road laws and motor vehicle inspection requirements prescribed by the relevant statutory authority.

14. INSURANCE
GameOn Motorsports will respond to any insurance claim made by the customer or insurance underwriter with respect to any mechanical works performed by GameOn Motorsports provided that the customer provides notification to GameOn Motorsports within 28 days.

15. GOVERNING LAW
The above terms and conditions are governed by the laws of New South Wales, Australia, and in
the event of a legal dispute relating to this Website, these Website Terms of Use or a Services Waiver, New South Wales courts will have non-exclusive jurisdiction.
