1. ACCEPTANCE OF AGREEMENT – BOUND BY USE
This website is created and controlled by GameOn Motorsports. Use or access of this website constitutes agreement to comply with and be bound by the following terms and conditions.
GameOn Motorsports reserves the right to amend these terms and conditions at any time without providing notice or reason to the subscriber.
2. MEMBERSHIP
If you are a website member, you may not have more than one active membership account with GameOn Motorsports at any time, whether due to a change of name, email, or address. You may update or terminate your membership account at any time.
If this condition is breached, you may become ineligible for any upcoming benefits or promotions offered by the website.
As a member of the GameOn Motorsports website, you are solely responsible for maintaining the confidentiality of your account and password. You are responsible for all activities that occur under your account and any consequences which follow.
3. USE OF MATERIALS, GRAPHICS AND TEXT
Unless stated otherwise, all material on this website is presented for the purpose of promoting GameOn Motorsports products and providing information to wholesalers and the general public.
Material from this website must not be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way without prior written consent.
4. PRICING
All prices are charged in Australian currency. Unless stated otherwise, the total transaction amount may vary depending on the exchange rate used by your credit card provider and the State from which you are ordering.
5. PRODUCT PRICING
GameOn Motorsports reserves the right to vary or modify product pricing at any time, including changes based on wholesaler pricing or promotional discounts.
6. ORDERS
Orders will not be dispatched until payment has been received in full and GameOn Motorsports is satisfied with the integrity of the order.
After placing an order, you will receive an order acknowledgment email. This does not constitute acceptance of your order. Your order constitutes an offer to purchase. GameOn Motorsports reserves the right to accept or decline any order in whole or in part.
If your order is accepted, you will receive confirmation once the product has been dispatched.
7. DELIVERY
GameOn Motorsports will use reasonable efforts to deliver products as soon as possible. It is the responsibility of the customer to notify GameOn Motorsports if an order does not arrive within a reasonable timeframe.
If an order is confirmed as lost in transit, GameOn Motorsports may resend the order or provide an alternative remedy at its discretion.
8. RETURNS
All returns must be authorised by GameOn Motorsports. Returns will only be accepted within 30 days of the delivery date.
Customers are responsible for the cost of shipping all returns and exchanges. Shipping and handling charges are not refundable.
GameOn Motorsports reserves the right to repair or replace faulty goods depending on the nature of the fault. Any fault caused by incorrect installation, misuse, modification, or poor handling will not be accepted as a warranty claim.
Any product that has been opened, used, installed, or damaged may not be accepted for return.
Nothing in this clause limits or excludes any rights or remedies available under Australian Consumer Law. Where goods are faulty, GameOn Motorsports will provide an appropriate remedy in accordance with Australian Consumer Law.
9. PROMOTIONS & CONDITIONS
GameOn Motorsports reserves the right to set conditions on all promotions and specials. Promotions are subject to change and are not valid once the prescribed period has ended.
10. SPECIALS / DISCOUNT VOUCHERS
Discount vouchers are valid for six (6) months from the date of purchase unless otherwise stated. Vouchers are not refundable or redeemable for cash and may not be exchanged unless at the discretion of GameOn Motorsports.
11. LINKS TO THIS WEBSITE
Links to this website are not permitted without prior written approval. GameOn Motorsports assumes no responsibility for content on any external website that links to this site.
12. LIABILITY
To the maximum extent permitted by law, GameOn Motorsports will not be liable for any direct, indirect, incidental, or consequential loss or damage arising from the use of this website or the purchase, installation, or use of any products supplied.
GameOn Motorsports provides no warranty as to the accuracy, completeness, or currency of website information.
Where liability cannot be excluded by law, liability is limited to resupplying the relevant goods or services or the cost of doing so.
13. INDEMNITY
13.1 Mechanical Works
Where GameOn Motorsports performs mechanical works outside factory specifications, such works are undertaken at the customer’s own risk. GameOn Motorsports is not responsible for injury, death, property damage, or consequential loss arising from such works.
The customer releases GameOn Motorsports, its employees, and agents from liability arising from fines, injury, loss, or damage, including where caused by negligence to the maximum extent permitted by law.
13.2 Roadworthiness & Compliance
GameOn Motorsports is not responsible for ensuring vehicle roadworthiness or compliance with road laws and statutory requirements.
14. INSURANCE
GameOn Motorsports will cooperate with any valid insurance claim relating to mechanical works performed, provided notification is received within 28 days.
15. GOVERNING LAW
These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes arising from the use of this website shall be subject to the exclusive jurisdiction of the courts of New South Wales.
